Terms of Use

By accessing and using the software, websites, and services (collectively, the "Services") provided by SoftGen Software Solutions, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our Services.

These Terms apply to all visitors, users, clients, and others who access the Services on behalf of an enterprise or as an individual.

Depending on your subscription or service agreement, SoftGen grants you a limited, non-exclusive, non-transferable, and revocable license to use our SaaS platforms and custom software.

• Restrictions: You may not reverse engineer, decompile, or disassemble any part of the software. You may not use the software to create a competitive product or service.
• Intellectual Property: SoftGen retains all right, title, and interest in and to the Services, including all related intellectual property rights. No rights are granted to you other than as expressly set forth herein.

You retain all rights to the data, information, or material you submit to our Services ("Client Data"). You are solely responsible for the accuracy, quality, integrity, legality, reliability, and appropriateness of all Client Data.

By submitting Client Data, you grant SoftGen a worldwide, royalty-free, non-exclusive license to host and use the Client Data strictly for the purpose of providing the Services to you.

We strive to provide 99.9% uptime for our enterprise SaaS platforms (e.g., ZisuGen, VizGen) as outlined in your specific Service Level Agreement (SLA). However, we do not guarantee that the Services will be uninterrupted or error-free at all times.

Scheduled maintenance windows will be communicated to enterprise clients at least 48 hours in advance. Emergency maintenance may occur without prior notice.

In no event shall SoftGen Software Solutions, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services; and
• Unauthorized access, use or alteration of your transmissions or content.

These Terms shall be governed and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
